Florida Weight-Loss Consumer Bill of Rights

The following statutory disclosures are provided in accordance with Florida Statutes section 501.0575. The Telehealth Services delivered through findmydirectdoctor.com may include, where clinically appropriate, the prescription of medications and the offering of a weight-loss program by the Healthcare Provider. FindMyDirectDoctor is not a weight-loss provider, dietitian, or nutritionist; clinical care, weight-loss treatment decisions, and the program prescribed to you are the responsibility of OpenLoop Healthcare Partners, PC and its affiliated professional corporations (the "Healthcare Provider"), as further described in Section 8 of the FindMyDirectDoctor Terms of Service, in the exercise of the Healthcare Provider's independent professional medical judgment.
Weight-Loss Consumer Bill of Rights (Fla. Stat. § 501.0575)
(A) WARNING: RAPID WEIGHT LOSS MAY CAUSE SERIOUS HEALTH PROBLEMS. RAPID WEIGHT LOSS IS WEIGHT LOSS OF MORE THAN 1 1/2 POUNDS TO 2 POUNDS PER WEEK OR WEIGHT LOSS OF MORE THAN 1 PERCENT OF BODY WEIGHT PER WEEK AFTER THE SECOND WEEK OF PARTICIPATION IN A WEIGHT-LOSS PROGRAM.
(B) CONSULT YOUR PERSONAL PHYSICIAN BEFORE STARTING ANY WEIGHT-LOSS PROGRAM.
(C) ONLY PERMANENT LIFESTYLE CHANGES, SUCH AS MAKING HEALTHFUL FOOD CHOICES AND INCREASING PHYSICAL ACTIVITY, PROMOTE LONG-TERM WEIGHT LOSS.
(D) QUALIFICATIONS OF THIS PROVIDER ARE AVAILABLE UPON REQUEST.
(E) YOU HAVE A RIGHT TO:
  1. 1.ASK QUESTIONS ABOUT THE POTENTIAL HEALTH RISKS OF THIS PROGRAM AND ITS NUTRITIONAL CONTENT, PSYCHOLOGICAL SUPPORT, AND EDUCATIONAL COMPONENTS.
  2. 2.RECEIVE AN ITEMIZED STATEMENT OF THE ACTUAL OR ESTIMATED PRICE OF THE WEIGHT-LOSS PROGRAM, INCLUDING EXTRA PRODUCTS, SERVICES, SUPPLEMENTS, EXAMINATIONS, AND LABORATORY TESTS.
  3. 3.KNOW THE ACTUAL OR ESTIMATED DURATION OF THE PROGRAM.
  4. 4.KNOW THE NAME, ADDRESS, AND QUALIFICATIONS OF THE DIETITIAN OR NUTRITIONIST WHO HAS REVIEWED AND APPROVED THE WEIGHT-LOSS PROGRAM ACCORDING TO s. 468.505(1)(j), FLORIDA STATUTES.
How to Exercise Your Rights
The weight-loss program offered by the Healthcare Provider through the Telehealth Services has been reviewed and approved consistent with Florida Statutes section 468.505(1)(j). The name, address, and qualifications of the dietitian or nutritionist who has reviewed and approved the weight-loss program, and the qualifications of the program's clinical providers, are maintained by the Healthcare Provider and are available upon request through any of the following channels:
If you have additional questions about the potential health risks of the weight-loss program, its nutritional content, psychological support, educational components, the itemized price of the program (including extra products, services, supplements, examinations, and laboratory tests), or the actual or estimated duration of the program, you may request that information using the same channels. The Healthcare Provider maintains the substantive program records and is the entity responsible for responding to your request.
FindMyDirectDoctor is not a weight-loss provider, dietitian, or nutritionist. The nutritional content, clinical protocols, program qualifications, and the credentials of the reviewing professional or professionals are the responsibility of the Healthcare Provider, which determines all clinical eligibility and treatment decisions in its independent professional medical judgment. Requests routed to FindMyDirectDoctor at [email protected] will be forwarded to the Healthcare Provider for substantive response.
